Late 1099 & Information Return Filing: What to Do Next
If an IRS filing or recipient-statement deadline has already passed, focus on accurate recovery: identify what is late, finish the data, file or furnish promptly, save acknowledgements, and document the cause of the delay.
Separate the problem before you fix it.
- Identify which deadline was missed.Recipient statement, IRS filing, or both.
- Confirm the exact form and tax year.Special dates can apply to 1099-NEC, 1099-B/DA/S, 5498-family returns and several other forms.
- Reconcile the source data.Do not turn a late filing into a late and inaccurate filing.
- Furnish late recipient statements promptly.Keep proof of when and how statements were provided.
- Validate and submit the IRS file.Save the IRIS acknowledgement and check the final status.
- Resolve rejected or accepted-with-errors records.Rejected transmissions and accepted-return corrections use different workflows.
- Document why the deadline was missed.Keep a contemporaneous file of system issues, missing data, vendor follow-up and corrective steps.
An extension request is a before-deadline tool.
Form 8809 generally must be filed by the information-return due date. Form 15397 generally must be received by the recipient-statement due date. Once the date has passed, the practical priority becomes accurate filing and documentation rather than assuming an extension can cure the lateness.
Keep a recovery file.
Save the source reconciliation, final CSV, recipient delivery records, IRIS acknowledgement, rejection details, correction records, and a dated explanation of what caused the delay. If the IRS later asks why the filing was late, a contemporaneous record is more useful than trying to reconstruct the sequence months later.

Late filing FAQs
Should I wait until every record is perfect before filing late returns?
Do not create unnecessary additional delay. Resolve known errors and file accurate returns as soon as practical. If a small number of records still require investigation, consider professional advice on how to handle them without holding back an otherwise ready filing.
Can Form 8809 be filed after the information-return due date?
The normal Form 8809 extension request must be filed by the applicable due date. After the deadline, do not assume a retroactive extension is available.
What if recipient statements are late too?
Treat the recipient obligation separately from the IRS filing. Furnish accurate statements as soon as practical and keep records of when and how they were furnished.
What if IRIS rejected my file on the due date?
Download and preserve the acknowledgement, identify the rejection, correct the underlying data and resubmit promptly. A rejected transmission requires a different recovery workflow from correcting an accepted return.
Does this guide calculate penalties?
No. Penalties depend on facts, timing, return counts, business size, intentional-disregard rules and possible reasonable-cause relief. The site intentionally does not provide a penalty calculator.
